Terms of Service

Note: These terms are a general template and should be reviewed by counsel before production use.

1. Agreement

By accessing or using SwissPer (the “Service”), you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

You must provide accurate information and keep your credentials confidential. You are responsible for activity on your account.

You acknowledge and agree that your data may be sent to external providers for processing, including cloud hosting, storage, email, analytics, payment processors, speech-to-text/LLM providers, and related vendors. We take appropriate contractual and technical measures as described in our Privacy Policy and GDPR Compliance page.

6. Acceptable use

You will not use the Service to break the law, infringe rights, harm others, or interfere with Service operation. We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

We and our licensors retain all rights to the Service, including software, models, and branding, except for your content as noted above.

8. Disclaimers

The Service is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.

9. Limitation of liability

To the maximum extent permitted by law, SwissPer will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill. Our aggregate liability for any claim relating to the Service will not exceed the amounts paid by you to SwissPer in the 12 months preceding the event giving rise to the claim.

You will comply with all applicable laws and regulations in Switzerland, the EEA/UK, and the United States, including privacy, consumer, and export control laws.

11. Governing law & venue

Unless prohibited by mandatory law, these Terms are governed by the laws of Switzerland, without regard to conflict of laws. The exclusive venue for disputes is the courts of [Canton/City], Switzerland. If you have consumers in other jurisdictions with mandatory protections, we will follow those where required.

12. Changes

We may modify these Terms. We’ll post updates here with a new effective date. Your continued use after changes constitutes acceptance.
